LakeFrog Privacy Policy

The following policy sets forth how LakeFrog.com, ("LakeFrog") collects, uses and discloses the information about LakeFrog customers and their authorized representatives ("Customers") that LakeFrog collects on this website (“Customer Information”). This policy applies to www.lakefrog.com and any web sites related to operation of the LakeFrog Services ("LakeFrog Services").

Information Collected.

During Customer registration, LakeFrog may collect identifiable information, including, but not limited to, name, company name, work address, e-mail address, phone number, credit card information, the names of principal authorized representatives who will work with LakeFrog, and any other information LakeFrog reasonably requires in order to provide access to LakeFrog’s software applications and services to its Customers including realtors, property vendors and members of the public listing information (“Customers”). Customers who use the LakeFrog Services may select user names and passwords, all of which are used to identify the Customers when they are using the LakeFrog Services.

LakeFrog may collect e-mail addresses of visitors (“User Email Lists”), who have provided their email addresses to LakeFrog or to Customers on behalf of LakeFrog for, among other things, the purpose of receiving communications from LakeFrog for the purpose of providing the LakeFrog Services. LakeFrog does not collect names, postal or e-mail addresses, and phone numbers of non-Customer visitors to LakeFrog's Web site, except to complete pending registration applications, to provide access to product demonstrations, or to respond to inquiries regarding the LakeFrog Services.

LakeFrog also collects information necessary to facilitate sending and tracking electronic mail outs for any Customers who have requested receipt of newsletters and information from LakeFrog, including open and read rates for each customer account.

LakeFrog may retain copies of any communications LakeFrog sends to or receives from Customers and other visitors to our site for our records, but may not use any such information except in accordance with the terms hereof.

Use of Collected Information.

LakeFrog utilizes the information submitted by prospective Customers to authenticate and verify the identity of such prospective Customers who may be communicating with LakeFrog. LakeFrog will use the information it collects during the registration process, and other information it collects while authenticating the identity of prospective Customers to evaluate the Customer's application for use of the LakeFrog Services and to conduct any continuing security, monitoring.

LakeFrog uses information it collects from Customers, including but not limited to the Client Email List, in connection the completion of any newsletter mailings either to Customers or on behalf of the Customers. LakeFrog may use such information to operate, maintain and enhance the LakeFrog Services and other services offered by LakeFrog. LakeFrog may also use Customer information to monitor compliance with the rules and policies of the LakeFrog Services.

LakeFrog compiles and analyzes its Customers’ information into aggregated research reports. Except as may be otherwise agreed in a separate agreement between LakeFrog and any Customer, LakeFrog may share this aggregated data with its business partners. However, except as set forth below, aggregated information is not identified with any particular Customer or any particular Customer's Representative or any particular Client Email List.

Customer access, update or deletion of information collected by LakeFrog.

Upon written request, LakeFrog will provide to Customer a summary of any Customer Information retained by LakeFrog regarding the Customer. Customers have a responsibility to keep certain information current particularly with respect to authorized representatives. Customers may correct, change or update the Customer Information, and information about their authorized representatives through the use of the customer login, password at www.lakefrog.com

Information Sharing.

LakeFrog and its authorized representatives have access to the Customer Information, including any information on the User Email Lists. LakeFrog will not disclose, sell, rent, license, exchange or release Customer Information to third parties except when LakeFrog has permission from Customer or when LakeFrog believes in good faith that the law requires it or under the circumstances described below. LakeFrog will disclose portions of the Customer Information such as bank account numbers to Customer’s banks which process payments.

LakeFrog may disclose Customer Information when LakeFrog has reason to believe that disclosing Customer Information is necessary to identify, contact or bring legal action against someone who may be violating the terms of use for the LakeFrog Services or may be causing injury to or interference (either intentionally or unintentionally) with LakeFrog rights or property, other LakeFrog Customers, or anyone else who could be harmed by such activities.

LakeFrog may share aggregated Customer Information with any third parties. From time to time, LakeFrog may retain the services of third-party service providers and consultants. LakeFrog may allow these third parties to access Customer Information, but only to the extent required to perform the tasks LakeFrog has retained them to perform that may include certain operations for the LakeFrog Services. LakeFrog's shall require such third parties to agree to maintain the confidentiality of Customer Information in compliance with the terms of this Privacy Policy.

Cookies

LakeFrog’s Web site(s) may use cookies to recognize each Customer as an authorized user of the LakeFrog Services, and allow us to provide customized services and improve the performance and usability of our website(s). LakeFrog may offer certain features that are only available through the use of a "cookie". Customer is always free to decline our cookies if its browser permits, although in that case such Customer may not be able to use certain features on LakeFrog’s website(s). LakeFrog may use advertisers or third-party service providers to serve ads when you visit our website. These third parties may also utilize their own cookies. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you. Customer choices regarding collection, use and distribution of Customer Information.

By accepting the terms of the terms of use for the LakeFrog Services and becoming a Customer, each Customer agrees that LakeFrog may collect certain information (as detailed in this Privacy Policy) from and about the Customer to authenticate the Customer and enroll the Customer as a user of the LakeFrog Services. If a prospective Customer does not agree to this Privacy Policy, it may not become a Customer.

LakeFrog may offer a Customer during registration or, through a follow-on email, the opportunity to receive offers and information about products and services from LakeFrog and its partners that LakeFrog believes may be of interest to the Customer. The Customer will be provided a choice whether to accept or not accept this offer. If Customer accepts, LakeFrog (or agents working on behalf of LakeFrog) may occasionally send the Customer such information. If this offer is not accepted, then Customer will not receive such information. If Customer initially accepts, Customer will be provided opportunity to discontinue receiving such information each time it is sent.

Customer Content.

LakeFrog may provide any of your relevant content to data feed systems and such content once so provided will be available to the general public through the LakeFrog site or any other services using the relevant data feed systems. Your content may be truncated to fit the attributes available on other sites or to fit within any character limits on any sites.

LakeFrog may obtain data and listings from third party sites for hosting on the LakeFrog Services. LakeFrog relies on the authorization to use any data and listings from the third party sites to post such data and listings. In the event LakeFrog obtains any data or listings from third party sites and such data or listings that belong to you, you will have the opportunity to notify LakeFrog that such data or listing as posted on the Lake Frog Services is your property. Once LakeFrog has verified that the data or listing has been originally and rightfully owned by you, you will have the opportunity to claim the listing and update any of the content associated with the property details You will have the opportunity to accept the posting on the LakeFrog Services or request removal of these listings from the LakeFrog Services. LakeFrog will request that you create and activate an account to claim the listing within its' systems. The content may be truncated to fit the attributes available on the LakeFrog Services or to fit within any character limits on the site.

Customer Contact.

LakeFrog reserves the right to contact Customers regarding account status and changes to the terms of use for the LakeFrog Services, this Privacy Policy, or any other policies or agreements relevant to Customers.

Security Precautions.

LakeFrog takes protective measures related to information security within the LakeFrog Services to ensure the confidentiality of sensitive Customer Information while stored or in use within the LakeFrog Services.

This Privacy Policy covers exchanges of information within the LakeFrog web sites and through Customer mailings. The LakeFrog sites may contain links to other sites but LakeFrog is not responsible for the privacy practices or the content of such sites.

Changes to the Privacy Policy.

LakeFrog may change this Privacy Policy at any time and will post the changes to the Privacy Policy on our Web sites. Any change to this Privacy Policy will become effective ten (10) business days after it is initially posted on the LakeFrog Web sites unless otherwise agreed with Customer in writing. Continued use of the LakeFrog Services following such period will mean that the Customer accepts such changes, which shall also bind its authorized representatives. If a Customer does not agree to any such change, it must terminate its agreement with LakeFrog and cease using the LakeFrog Services.
